Change of EMC Directive (Urgent - Dangerous)

As part of the NEW LEGISLATIVE FRAMEWORK (NLF) ALIGNMENT PACKAGE the European Commission is reworking some directives. One of the affected directives is the EMC directive including some major changes. Most of them are neutral or even good from an amateur radio operators perspective. However there are two slight changes pickaback carried, which very much affect us. In short words:
Como parte del nuevo marco legislativo (FLN) PAQUETE DE ALINEACIÓN la Comisión Europea es volver a trabajar algunas directivas. Una de las directivas afectadas es la directiva EMC incluyendo algunos cambios importantes. La mayoría de ellos son neutrales o incluso de una buena perspectiva de los operadores de radio aficionados. Sin embargo, hay dos pequeños cambios realizados, que mucho nos afectan. En pocas palabras:
1. The sentence “Kits of components to be assembled by radio amateurs and commercial equipment modified by and for the use of radio amateurs are not regarded as commercially available equipment.” is to be deleted in the new version. That would render kits and modified equipment to be fully subjected to the EMC directive!

La frase "kits de componentes para ser montados por radioaficionados y los equipos comerciales modificados por y para el uso de radioaficionados no se consideran equipos disponibles en el mercado." Se van a eliminar en la nueva versión. Eso haría que los kits y equipos modificados han ser plenamente sujetos a la directiva EMC!
2. The definition of the term ‘electromagnetic disturbance’ will include the wanted signal of a radio as a possible source. This is not in line with the radio regulation of the International Telecommunication Union (ITU) and not in line with the vocabulary of the International Electrotechnical Committee (IEC).
2. La definición de "perturbación electromagnética" el término incluye la señal deseada de una radio como una posible fuente. Esto no está de acuerdo con el Reglamento de Radiocomunicaciones de la Unión Internacional de Telecomunicaciones (UIT) y tampoco en línea con el vocabulario de la Comisión Electrotécnica Internacional (IEC).
IARU Region 1 will respond to it with a letter soon.
However we strongly suggest, that you contact your local MEPs and tell them about those two changes in the EMCD, that are neither in line with the reasoning of the New Legislative Framework, nor does it help to improve protection of radio services or equipment.
La IARU Región 1 responderá a ella con una carta muy pronto.
Sin embargo le recomendamos que se ponga en contacto los responsables políticos locales y hablarles acerca de los dos cambios en el EMCD, que no están en línea con el razonamiento del nuevo marco legislativo, ni ayuda a mejorar la protección de los servicios de radio o de los equipo.
